  16.    SEC. 120001. EXTENSION OF THE STATUTE OF LIMITATION FOR
  17.    TERRORISM OFFENSES.
  18.    
  19.    
  20.    
  21.    (a) In General .-Chapter 213 of title 18, United States Code,
  22.    amended by inserting after section 3285 the following new
  23.    
  24.    
  25.    
  26.    " 3286. Extension of statute of limitation for certain terrorism
  27.    offenses
  28.    
  29.    
  30.    
  31.    "Notwithstanding section 3282, no person shall be prosecuted, tried,
  32.    or punished for any offense involving a violation of section 32
  33.    (aircraft destruction), section 36 (airport violence), section 112
  34.    (assaults upon diplomats), section 351 (crimes against Congressmen or
  35.    Cabinet officers), section 1116 (crimes against diplomats), section
  36.    1203 (hostage taking), section 1361 (willful injury to government
  37.    property), section 1751 (crimes against the President), section 2280
  38.    (maritime violence), section 2281 (maritime platform violence),
  39.    section 2331 (terrorist acts abroad against United States nationals),
  40.    section 2339 (use of weapons of mass destruction), or section 2340A
  41.    (torture) of this title or section 46502, 46504, 46505, or 46506 of
  42.    title 49, unless the indictment is found or the information is
  43.    instituted within 8 years after the offense was committed.".

  47.    (b) Application of Amendment .-The amendment made by subsection (a)
  48.    shall not apply to any offense committed more than 5 years prior to
  49.    the date of enactment of this Act.

  53.    (c) Technical Amendment .-The chapter analysis for chapter 213 of
  54.    title 18, United States Code, is amended by inserting after the item
  55.    relating to section 3285 the following new item:
  56.    
  57.    
  58.    
  59.    "3286. Extension of statute of limitation for certain terrorism
  60.    offenses.".

  64.    SEC. 120002. JURISDICTION OVER CRIMES AGAINST UNITED STATES NATIONALS
  65.    ON CERTAIN FOREIGN SHIPS.
  66.    
  67.    
  68.    
  69.    Section 7 of title 18, United States Code (relating to the special
  70.    maritime and territorial jurisdiction of the United States), is
  71.    amended by inserting at the end thereof the following new paragraph:
  72.    
  73.    
  74.    
  75.    "(8) To the extent permitted by international law, any foreign vessel
  76.    during a voyage having a scheduled departure from or arrival in the
  77.    United States with respect to an offense committed by or against a
  78.    national of the United States.".

  82.    SEC. 120003. COUNTERFEITING UNITED STATES CURRENCY ABROAD.

  85.    
  86.    (a) In General .-Chapter 25 of title 18, United States Code, is
  87.    amended by adding before section 471 the following new section:
  88.    
  89.    
  90.    
  91.    " 470. Counterfeit acts committed outside the United States
  92.    
  93.    
  94.    
  95.    "A person who, outside the United States, engages in the act of-
  96.    
  97.    
  98.    
  99.    "(1) making, dealing, or possessing any counterfeit obligation or
  100.    other security of the United States; or
  101.    
  102.    
  103.    
  104.    "(2) making, dealing, or possessing any plate, stone, or other thing,
  105.    or any part thereof, used to counterfeit such obligation or security,
  106.    
  107.    
  108.    
  109.    if such act would constitute a violation of section 471, 473, or 474
  110.    if committed within the United States, shall be fined under this
  111.    title, imprisoned not more than 20 years, or both.".

  115.    (b) Technical Amendments .-

  119.    (1) Chapter analysis .-The chapter analysis for chapter 25 of title
  120.    18, United States Code, is amended by adding before section 471 the
  121.    following new item:

  129.    (2) Part analysis .-The part analysis for part I of title 18, United
  130.    States Code, is amended by amending the item for chapter 25 to read as

  143.    SEC. 120004. SENTENCING GUIDELINES INCREASE FOR TERRORIST CRIMES.
  144.

  146.    
  147.    The United States Sentencing Commission is directed to amend its
  148.    sentencing guidelines to provide an appropriate enhancement for any
  149.    felony, whether committed within or outside the United States, that
  150.    involves or is intended to promote international terrorism, unless
  151.    such involvement or intent is itself an element of the crime.

  155.    SEC. 120005. PROVIDING MATERIAL SUPPORT TO TERRORISTS.
  156.    
  157.    
  158.    
  159.    (a) Offense .-Chapter 113A of title 18, United States Code, is amended
  160.    by adding the following new section:
  161.    
  162.    
  163.    
  164.    " 2339A. Providing material support to terrorists
  165.    
  166.    
  167.    
  168.    "(a) Definition .-In this section, 'material support or resources'
  169.    means currency or other financial securities, financial services,
  170.    lodging, training, safehouses, false documentation or identification,
  171.    communications equipment, facilities, weapons, lethal substances,
  172.    explosives, personnel, transportation, and other physical assets, but
  173.    does not include humanitarian assistance to persons not directly
  174.    involved in such violations.

  178.    "(b) Offense .-A person who, within the United States, provides
  179.    material support or resources or conceals or disguises the nature,
  180.    location, source, or ownership of material support or resources,
  181.    knowing or intending that they are to be used in preparation for, or
  182.    in carrying out, a violation of section 32, 36, 351, 844 (f) or (i),
  183.    1114, 1116, 1203, 1361, 1363, 1751, 2280, 2281, 2331, or 2339 of this
  184.    title or section 46502 of title 49, or in preparation for or carrying
  185.    out the concealment of an escape from the commission of any such
  186.    violation, shall be fined under this title, imprisoned not more than
  187.    10 years, or both.

  191.    "(c) Investigations .-
  192.    
  193.    
  194.    
  195.    "(1) In general .-Within the United States, an investigation may be
  196.    initiated or continued under this section only when facts reasonably
  197.    indicate that-
  198.    
  199.    
  200.    
  201.    "(A) in the case of an individual, the individual knowingly or
  202.    intentionally engages, has engaged, or is about to engage in the
  203.    violation of this or any other Federal criminal law; and [*H8834]
  204.    
  205.    
  206.    
  207.    "(B) in the case of a group of individuals, the group knowingly or
  208.    intentionally engages, has engaged, or is about to engage in the
  209.    violation of this or any other Federal criminal law.

  213.    "(2) Activities protected by the first amendment .-An investigation
  214.    may not be initiated or continued under this section based on
  215.    activities protected by the First Amendment to the Constitution,
  216.    including expressions of support or the provision of financial support
  217.    for the nonviolent political, religious, philosophical, or ideological
  218.    goals or beliefs of any person or group.".

  222.    (b) Technical Amendment .-The chapter analysis for chapter 113A of
  223.    title 18, United States Code, is amended by adding the following new
  224.    item:
